So many men are planning or married to wives of other people. These sisters did not seek for divorce properly, they only got separated. Without due diligence on the part of these men, they have ended up marrying women who are still in marriage but not living with their husbands.
It is important to understand the process of Talaq or khu’l, and how it has been applied before tying the knot with a previously married woman. There is big difference between separation and divorce, if you legally disestablish the marriage, it is called divorce, for one or two reasons, couple can still be married but living apart, this is separation.
As a sister, it is appropriate to seek divorce from the Shari’a court, or wait for the three pronouncements from the husband before you can be acknowledged to have disengaged the existing union.
Marriage has process, and to leave the union also commands procedure, and when it is not properly done, you might be getting yourself in adultery in disguise.
Always pay attention to details.
